The Return of the Strike: How to Counter Strikes, Pickets & Boycotts

Workplace activism is on the rise, and work stoppages ranging from labor union-led strikes to spontaneous employee walkouts have been at historic levels. This program will examine what kinds of activity is lawful, and most importantly, how to equip your employer with the best contingency plan to counter the effectiveness of a strike or picketing activity.

Join Fisher Phillips Labor Relations co-chair, Todd Lyon, and attorney Alex Desrosiers for a full-day labor relations program on how to prepare for and succeed in the face of strikes, pickets, and boycotts. Whether a non-union organization or an employer with a longstanding labor relationship – operations managers, human resources leaders, and labor relations managers will learn “where the legal lines are” with respect to the latest strike tactics utilized by organized labor – with one eye on where the law stands today – and another on where it may be going. 

The firm is submitting this training for HRCI/SHRM credit. Fisher Phillips will make all reasonable efforts to obtain CLE credit for this program in every state that is relevant to attendee’s MCLE needs. Todd A. Lyon, Partner & Co-Chair, Labor Relations Practice Group, Fisher Phillips

Todd Lyon is the co-chair of the firm's Labor Relations Practice Group and practices throughout the West Coast. He has been a labor lawyer for nearly 25 years, representing public and private sector employers in labor negotiations, collective bargaining, grievance and interest arbitrations, strikes/lockouts, relocation and closures, work jurisdiction disputes, and other litigation involving employment law and benefits.

Todd formerly represented labor organizations in both Chicago and Seattle. Drawing from this union-side experience, Todd provides a unique perspective to the advantage of his employer clients.  His practical and efficient approach allows him to help clients reach their goals without creating a wake of destructive relations. 

If litigation is required, however, Todd has obtained superior results in hundreds of arbitrations concerning virtually every aspect of contract interpretation, discipline, union security, and interest arbitration. Relatedly, Todd has conducted labor board hearings concerning representation, unfair labor practices, work jurisdiction disputes, and unit clarifications. 

Todd is a skilled negotiator who bargains pro-employer collective bargaining agreements. He has negotiated over a hundred labor agreements covering industries including:

  • Construction
  • Aerospace
  • Manufacturing and food processing
  • Logistics, transportation & warehousing
  • Cannabis
  • Hospitality
  • Healthcare
  • Public sector employers including cities, counties, and special districts

He has developed and implemented union awareness and strike & replacement worker contingency plans. He regularly assists clients in responding to union organizing campaigns and developing labor strategies to avoid campaigns altogether. This work includes successfully defending against multi-site organizing blitzes and card-check neutrality campaigns.

Todd is a regular speaker at industry conferences, continuing legal education programs, universities, law schools, and client training programs. He has led countless management training sessions focused on investigating disciplinary misconduct, effective discipline, union awareness, responding to grievances, contract negotiations and interpretation,  and employment discrimination.

An avid researcher and writer, Todd’s work has appeared in various labor publications. For example, since 1998 he has been a Chapter Editor of   The Developing Labor Law, the nation's leading labor law treatise. Todd has also served as a Chapter Editor for Oregon's public sector labor law treatise, Labor and Employment Law: Public Sector.

Due to his experience in representing parties on both sides of the labor spectrum, the American Arbitration Association has certified him as an Employment Law Arbitrator to adjudicate employment disputes.

Alex G. Desrosiers, Associate, Fisher Philips

Alex, an attorney in the Orlando office and integral member of the firm’s Labor Relations Group, advises and represents employers across the country in traditional labor matters related to union organization, grievance arbitrations, contract interpretation, work stoppages and unfair labor practices. He regularly counsels private and public-sector employers and their managers in a variety of labor, employment and business matters, including:

  • pre-hire and onboarding
  • employee handbooks and employment policies
  • performance management
  • requests for medical leaves of absence and reasonable accommodations
  • termination and severance agreements
  • labor relations
  • restrictive covenants

As a trusted litigator, Alex also represents employers of all sizes before state and federal courts, and before administrative agencies, as well as in arbitration. Alex has significant experience litigating claims of discrimination, retaliation, wage and hour violations, and restrictive covenant/noncompete disputes.

Alex is also an avid speaker and frequently travels around the state to keep employers and HR professionals informed about the ever-changing workplace landscape. Recently, he co-hosted a presentation on Florida’s Individual Freedom Act, dubbed the “Stop WOKE Act,” for the Hospitality Human Resources Association to advise employers on what they can do to ensure compliance with the Act. In September, Alex spoke at the 2022 HR Florida Conference and Exposition about how to “Build a Positive Employee Relations Program Amid the Next Wave of Union Organizing Activity.”

Outside the office, Alex serves on the Board of Directors for the Crohn’s and Colitis Foundation – Central and Northeast Florida Chapter.
