The Office of Environmental Health Hazard Assessment (OEHHA) has updated the regulations for Proposition 65, which became effective on August 30, 2018.
These new regulations, if followed, act as a “safe harbor” for hotel and lodging properties. Hotels that follow these provisions will be in compliance with Prop 65.
It’s important that hotel and lodging properties update their signage not only to inform guests and visitors, but to minimize liability from Prop 65 lawsuits. Not complying with these new regulations greatly increases your risk of being sued.
